Fairness in Hiring and Promotions, Employee’s Rights and Duties

Business Ethics has been an issue for the past four thousand years. The Mesopotamian rulers attempted to create honest prices and the Aristotle discussed the vices and virtues of tradesmen and merchants. In the Old Testament there are discussions on the topic of fraud, theft, proper weights, and competition; in the New Testament business ethics as it relates to poverty and wealth are discussed (Hoffman, Frederick, & Schwartz, 2001, p. 3). This principle is referred to as the veil of ignorance. “This ensures that no one is advantaged or disadvantaged in the choice of principles by the outcome of natural chance or the contingency of social circumstances. Since all are similarly situated and no one is able to design principles to favor his particular condition, the principles of justice are the result of a fair agreement or bargain” (Hoffman, Frederick, Schwartz, 2001, p.54). Rawls’ theory of Justice is based on the principle of protecting the rights of equality and liberty (J. Rawls, 1999).
In principle of Distributive Justice is equal dissemination of common goods and services. Distributive justice relates to fair and equal distribution of benefits for all, not from a priority status. The common goods and services include fairness in income and economic wealth, education, work, and political power, etc. However, the question can be asked, what exactly constitutes a fair and equal distribution? Michael Walzer (1976), for example, writes that “Distributive justice is a large idea,” and for John Rawls (1976) “Justice is the first virtue of social institutions.” Justice arguments are invoked in connection with social programs such as Affirmation Action Polices, Medicare, and social security, public education. This is widely regarded as an important concept in philosophy and the social sciences.
In contrast, Utilitarianism theory is based the concept that when one is faced with a choice, they will choose the option that will provide the most pleasure or happiness, but one must consider the potential consequences of their actions. Nineteenth century British philosopher John Stuart Mill is best known for his theory of Utilitarianism. Mill’s utilitarianism theory is based on maximizing total happiness. “The notion of justice in not a function of utilitarians, they have views about the distribution of wealth, savings for the benefit of future generations and for the third world countries and other practical matters. Utilitarianism differs from John Rawls’ theory in that it is ready to contemplate some sacrifice to certain individuals (or classes of individuals) for the sake of the greater good of all, and in particular may allow certain limitations of personal freedom which would be ruled out by Rawls’ theory. In practice, however, the general tendency of utilitarianism may well be towards an egalitarian form of society” (Hoffman, Frederick, Schwartz, 2001, p.69).
In the US and abroad, many recognize that Capitalism produces greater material abundance for more people than any other economic system (Hoffman, Frederick, Schwartz, 2001, p.70).
