2.2 The EC Package Travel Regulations.The Regulations apply to packages sold or offered for sale in the UK.A package is defined as a trip which is prearranged and sold on and involves at least one overnight stay with the all-in-price covering at least two of the following; transport, accommodation, other tourist services, such as excursions, which account for a portion of the package. The main purpose of the Regulations is to give people buying package holidays more protection and access to compensation when things go wrong. The Regulations also specify what kind of information should be included in the brochures such as, type of accommodation, means of transport and the destination. Other responsibilities and duties the Regulations places is to give emergency phone numbers, provide proof of ABTA Bondings and provide information of any available insurance companies.2.3 Trade Description Act 1968.This Act protects customers against false descriptions by those who are selling or providing services, including tour operator's products and services. Any description of a hotel must be truthful at the time it was written, for example showing pictures of a hotel with a swimming pool that actually does not have a swimming would be not untruthful. This Act protects customers from tour operators or other tourism facilities that produce brochures not to deceive them.2.4 The Unfair Contract Terms Act 1977.The Unfair Contract Terms Act forbids tour operators to say that they are not responsible for any problems which might arise on a holiday or avoid responsibility in death and injuries in some cases. For example, tour operators cannot write into the booking conditions that they are not responsible for what happens in a resort or hotel because they do not own it.Tour operators are responsible for seeing that hotels meet acceptable standards, as described in their brochures. Standard contract terms should be written in clear, understandable language.Section 3: 'Cruise & Stay Hawaii Brochure.Thomas cook offers cruising around Hawaii with Norwegian Cruise Lines America, they are the only ships that offer inter- islands Hawaii cruising. The Cruise Ships stop at port O'ahu, Maui, the Big Island of Hawaii and Kaua'i. The three ships of NCL America are: Pride of Aloha, Pride of America and Pride of Hawaii.
