Role and Functions of Law
This paper will discuss the functions and role of law in business and society. It will explain the functions and role of law in my past job as a Border Patrol Agent.
According to Melvin, “law is a body of rules of action or conduct prescribed by controlling authority, and having legal binding force” (pg. 4). In essence, the law functions as a set of rules for both society and business. By creating a framework of rules or laws within business it helps to level the playing field, keeping the market competitive and fair. The Commerce Clause essentially gives Congress the power to regulate commerce. This plays a huge role within the function of law for both society and business. This causes people who are traveling across states lines to not only be familiar with the laws of the states they are traveling through, but also the Federal laws regarding interstate commerce. As far as business is concerned this regulates how businesses are importing and exporting products to other states and overseas transport their products and materials.
As a Border Patrol Agent working under the Department of Homeland Security, my work was the enforcement of laws along the Southern Border of the United States. One of my duties was the enforcement of Federal Criminal Laws. This was mostly the enforcement against narcotics trafficking, smuggling, human trafficking and anti terrorism. This portion of my job required me to be familiar with Federal Statutes and waivers on many different topics.
