Abstract
The functions of law in society and role of law in business, differ in many ways, primarily in the area of punishment. Criminal laws relating to society and laws that govern business and the enforcement of these laws are not only based on state by state mandates, but they are also governed by laws that blanket all states and citizens under the constitution or federal laws.

The Cigarette Labeling and Advertising Act of 1969 was instrumental in protecting consumers and cigarette manufacturers from lawsuits stemming from cigarette smoking caused illnesses such as cancer or emphysema. The Public Health Cigarette Smoking Act of 1969 was an “amendment” or “upgrade” to The Federal Cigarette Labeling and Advertising Act of 1965 which changed the required the warning label wording from "Caution: Cigarette Smoking May Be Hazardous to Your Health" to “Warning: The Surgeon General Has Determined that Cigarette Smoking Is Dangerous to Your Health" (cdc.gov). In the Act of 1965 the words “may be hazardous” gives no clear indication of a serious potential health threat and therefore can be interpreted as “not a proven risk” to smokers.
An example is the case of Cipollone v. Liggett Group, Inc., a lawsuit brought against a cigarette company by the relatives of a woman who smoked by personal choice, willingly, voluntarily and knowingly, despite warnings and health concerns. After several trial attempts, The Supreme Court ruled against Cipollone reasoning in the verdict “Preemption: Congress chose specifically to regulate a certain type of advertising (tobacco), federal law is supreme to any state law that attempts to regulate that same category of advertising”. (Cipollone v. Liggett Group, Inc., et al., 505 U.S. 504 (1992).
