Legal Encounter #1
In legal encounter 1, there are definite liability issues on WireTechs behalf. The first legal principle is the employee handbook presented to Clark at the beginning of his employment with WireTech. The employee handbook could represent a contract between the employer and the employee. Upon employment Clark did acknowledge that the company had an “at will” policy when terminating employees. WireTech’s rights are that Clark did acknowledge and signed that he understood that WireTech is an “at will” company. This means that WireTech can fire any employee for any reason. Clark is also liable for assuming WireTech’s provisions limited the ability to fire him. My recommendation would be to let Clark go with 30-day notice and severance pay. WireTech is well within their legal rights to fire Clark because they are an “at will” employer.

Legal Encounter #2
In legal encounter 2 WireTech can be held liable for the following: sexual harassment in the workplace, and discrimination. The legal principles in this simulation are that Sam is Charlotte’s supervisor they had a romantic affair that went south. Sam now is clearly upset he constantly exhibits unwanted behavior towards Charlotte even though she has asked him to stop he still continues the unwanted behavior. This makes WireTech liable for a sexual harassment lawsuit. Additionally, WireTech can be held liable for sex discrimination and pregnancy Issues. In the landmark case International Union v. Johnson Controls, Inc. this cases focuses on this issue at hand. Women should have the right to choose high-risk jobs. It is my belief that if a women chooses to work in a high-risk environment that could put her baby at harm that is her choice. Women choose everyday to have abortions. If a woman can decide to abort her unborn child certainly she can decide to work in a potential high-risk department that could harm her baby. The company has done its duty by advising those risks. As long as the company has the employee sign proper documentation that she has been informed of all risk involved she should be able to move to the new department.
WireTech is leaving the door wide open on potential lawsuits by not doing anything. It is my recommendation that Charlotte should be assigned a new supervisor.
