In the field of Criminal Justice in America it is important to explore the parts of the criminal justice systems and the processes that occur. Many of the parts and processes in the Criminal Justice System shall be discussed in this work. Crime will be defined in relation to the law. Models of how society views acts as criminals will be reviewed. Choice theories will also be revealed in this work. The Consensus Model is based upon that there is agreement among the Parts of the criminal justice system. All parts work in harmony according to this theory to achieve justice (p. 17). The next model is that of the Conflict model which is based on the parts of the Criminal Justice System in America are selfish entities. Justice is based on conflict and self serving motives according to this model. (p. 17). There are theories related to choice as reading continued that are important to note.
There are several choice theories that tell why people choose to commit crimes in America. The Social Development theory states that a pattern that can be predetermined causes criminal behavior. The rational choice theory assumes that crime is a knowing choice. Biological theories state that ones biological make-up causes them to commit crimes (pp. 90-84). Having criminals in one’s family is also noted as a reason why people choose to commit crimes throughout the United States. Along with choice theories goes the measurement of crime.
The components for criminal justice are, legislative, courts, and corrections. The criminal justice process consist of, an investigation of a crime by the police. The whole purpose of a criminal investigation is to gather as much evidence as possible to identify a suspect and support an arrest. Arrest of a suspect by the police. This involves taking a person into custody for holding the suspect until the date of court. Prosecution of a criminal defendant by the district attorney. When deciding whether to change a person with the crime a prosecutors weigh out many factors, including the seriousness of the offense and the strength of the evidence. You also have, indictment, arraignment, pretrial detention plea bargaining, trial/adjudication of guilt, sentencing, and appeals. An appeal is filed by attorneys in appellate courts and the ruled on by appellate judges.
