Write a short research paper regarding the Bhopal chemical plant explosion. Your task is to critique, form an ethics standpoint, the Union Carbide Corporation’s response to the disaster, focusing specifically on the company’s legal strategy.

To discuss the ethical standards that were adhered by during the Bhopal disaster we first need to understand the relationship between law and ethics. Ethics and legal principles are usually closely related, however ethical obligations typically exceed legal duties. Also, while ethical beliefs lead to developing regulations that prevent/encourage certain behaviors, laws and regulations usually prevent certain behaviors. This is one instance I wasn’t quite fond of what UCC stated. If you as a business decide to conduct a venture with another entity you need to assume and realize everything that could encompass the business you open up, even negative and horrendous disasters like the one they experienced.
Keep in mind this wasn’t an act of god, but a deliberate act of negligence. If UCC and UCIL would have been cautious and ethically responsible in the first place by either, checking on international and national safety standards, check on quality audits, check automated safety mechanisms within the factory, educate the product and safety to all workers, and have multiple contingency options, this could have been prevented. However UCC dismissed it’s leadership role as co-owner and neglected to take precautions from something like this happening, while acting as a “stockholder”.
Once the victims started filing suit against UCC, and UCC started distancing itself form UCIL they did do something very sketchy, but well planned out in my opinion. They first joined all the individual lawsuits into one case, which makes it very economical for them. The second thing that surprised me, but makes sense at the same time is UCC declaring forum non conveniens. This would be great for UCC since they conducted business in India with UCIL and the Indian Government. In the reading for this class and articles online it says UCC choose to move the case to Indian Courts because they’re less plaintiff friendly and because of the prolonged process it took for litigation. However, I feel this is what UCC wanted you to believe, knowing that they could bribe the courts a.k.a. government into a settlement of $470 million, without having to pay billions in reparations since they were majority stock holder/owner.
